The California SB 54 packaging EPR deadlines are not upcoming. They are behind us, and that is the reason to read this now rather than in January.

California's final extended producer responsibility regulations for packaging took effect on 1 May 2026, the day they were filed. That filing opened a 30-day compliance window, which closed on 1 June 2026. A seller who ships packaged product into California and did nothing in May is not early for 2027. They are late for 2026.

What the California SB 54 packaging EPR deadlines actually were

Drawing on the published legal analyses of the final rules from Mayer Brown and Holland and Knight:

  • 1 May 2026: the regulations became effective on filing
  • 1 June 2026: producer registration deadline, the first business day after the 30-day window
  • 1 July 2026: the California baseline producer report, built on 2023 data, was due
  • 1 January 2027: full program implementation begins

From 2027, annual reports are generally due on 1 July each year, covering the prior calendar year. CalRecycle's own packaging EPR program page confirms the program covers packaging and single-use plastic food service ware across every sector of the economy. Verify the specific dates against CalRecycle before you act on them: the legal analyses agree with each other, but the dates here come from those analyses rather than from a CalRecycle notice.

The three doors, and the one most sellers needed

By the June deadline a producer had to pick one of three paths:

  1. Join the producer responsibility organisation, the Circular Action Alliance, and submit supply data
  2. Register directly with CalRecycle as an independent producer, through the Packaging Pro application
  3. Claim the small producer exemption, for gross sales under one million dollars in California in the prior calendar year

That third door matters more than it looks. The exemption is not automatic. It is claimed. A seller under the threshold who assumed the law was not about them has the same paperwork gap as a seller over it - they just have a smaller problem to fix.

And note what the threshold measures: sales in California, in the prior calendar year. Not total revenue, not units, not profit. For a lot of Amazon sellers, California alone is a meaningful share of US volume, and the number that decides your status is one your own reporting can give you in an afternoon.

Why this reaches sellers who do not think of themselves as producers

The word producer does the damage here. Sellers read it as manufacturer, decide it is their supplier's problem, and move on. Packaging EPR laws generally reach the brand owner whose name is on the product, not the factory that made the box, and CalRecycle estimates 5,741 producers fall inside this program. If you own the brand and the packaging ships into California, run the determination rather than assume the answer.

The wider pattern is the one worth keeping. Packaging EPR is not one deadline, it is a rolling registry obligation, arriving state by state on separate calendars. Oregon, Colorado, Maine and others each have their own clock. California is simply the largest and the furthest along, which makes it the one that tells you what the others will look like.

What to do this week

Pull California gross sales for calendar year 2025. That single number tells you whether you needed to register or to claim an exemption. Then check whether either was filed - by you, by your compliance provider, or by nobody.

If the answer is nobody, register or claim now rather than at the January start. A missed deadline that is being fixed is a different conversation with a regulator than a missed deadline nobody has touched, and 1 January 2027 is when the program stops being paperwork and starts being enforcement.
